By downloading, accessing, or using the Themeparky application ("App") or services provided by hex321 LLC ("we," "our," or "us"), you agree to be bound by these Terms of Service ("Terms") and End User License Agreement (EULA). You must be at least 13 years old to create an account or use Themeparky. If you do not agree to these Terms, do not install or use the App.
Themeparky is an independent software tool providing real-time theme park intelligence, queue wait-time tracking, ride reopening alerts, and trip planning features. Themeparky and hex321 LLC are independent projects and are not affiliated with, endorsed by, or sponsored by Walt Disney Parks & Resorts, Universal Destinations & Experiences, Six Flags Entertainment, Cedar Fair, or any other theme park operator. All park names, ride trademarks, and brand names belong to their respective owners.
Certain features may require registering an account or providing a valid email address. You are responsible for maintaining the confidentiality of your login credentials and for all activities under your account. You agree to notify us immediately of any unauthorized account access. hex321 LLC reserves the right to suspend or terminate accounts for violations of these Terms. You may delete your account and all associated data at any time by contacting [email protected].
Subject to your compliance with these Terms, hex321 LLC grants you a limited, non-exclusive, non-transferable, revocable license to use the App for personal, non-commercial purposes. You agree not to: (a) reverse engineer, decompile, or extract source code from the App; (b) use automated bots, scrapers, or tools to harvest data; (c) resell, redistribute, or commercially exploit the Service; or (d) interfere with system operations.
Themeparky offers premium features through pass options, including Non-Renewing Passes (e.g., Week Pass), Auto-Renewing Subscriptions (e.g., Annual Pass), and Lifetime Passes (granting access for the operational lifespan of the Themeparky service). All payments are processed securely through the app store platform associated with your device (Apple App Store for iOS or Google Play Store for Android). Payment will be charged to your Apple ID or Google Account at confirmation of purchase. Subscriptions automatically renew unless canceled at least 24 hours before the end of the current billing period. Your account will be charged for renewal within 24 hours prior to the end of the current billing period. You can manage or cancel your subscriptions at any time through your device store settings: iOS (Apple) in Settings ➔ Apple ID ➔ Subscriptions (https://apps.apple.com/account/subscriptions), or Android (Google Play) in Google Play ➔ Profile ➔ Payments & Subscriptions (https://play.google.com/store/account/subscriptions). All purchases are subject to the applicable refund policies of Apple or Google.
If you submit ride reports, wait-time updates, or park feedback through Themeparky, you grant hex321 LLC a worldwide, non-exclusive, royalty-free, perpetual license to use, publish, and integrate such data into our services to improve accuracy for all users. Submissions must not contain unlawful, abusive, or infringing material.
Themeparky utilizes location services and push notifications to provide proximity-based ride alerts and queue recommendations. Location data accuracy depends on hardware capabilities, network conditions, and third-party providers. You can disable location tracking or notifications at any time in your device settings.
The Service is provided on an "as is" and "as available" basis without warranties of any kind. Real-time wait times, ride operational statuses, and park schedules are collected from dynamic third-party data feeds and user submissions, and hex321 LLC does not guarantee complete accuracy. We reserve the right to modify, update, add, suspend, or discontinue any feature, AI tool, or portion of the App at any time without notice or liability. Additionally, you agree to comply with all theme park rules, posted safety signs, codes of conduct, and instructions from park personnel while using the App. hex321 LLC is not responsible for any personal injury, park ejection, line-jumping violations, missed ride reservations, or loss of park admission resulting from your use of the App inside any theme park.
To the maximum extent permitted by law, hex321 LLC shall not be liable for any indirect, incidental, consequential, or punitive damages resulting from your use of or inability to use the Service. In no event shall total aggregate liability exceed the total amount paid by you to hex321 LLC for the Service in the twelve (12) months preceding the claim. You agree to defend and indemnify hex321 LLC against any claims arising from your violation of these Terms.
These Terms shall be governed by and construed in accordance with the laws of the State of California, United States, without regard to conflict of law principles. Any dispute arising out of or relating to these Terms or the App shall be resolved exclusively in the state or federal courts located in California.
You acknowledge that these Terms are between you and hex321 LLC only, not Apple Inc. ("Apple") or Google LLC ("Google"). hex321 LLC is solely responsible for the App and its content. Maintenance and support are provided solely by hex321 LLC. Apple has no warranty obligation whatsoever other than refunding the purchase price if the App fails to conform to applicable express warranties. Apple and its subsidiaries are third-party beneficiaries of these Terms and have the right to enforce them against you. For Android users, your download and use of the App is also governed by the Google Play Terms of Service.
We reserve the right to modify these Terms at any time. We will notify you of material changes by updating the "Last updated" date at the top of these Terms. Continued use of the App after any modifications constitutes your acceptance of the revised Terms.
